Safety, Ticket, and Service Prices

(1.1) SAFETY ON BOARD AND AT SEA

(1.1.1) The service provider has the right to refuse service to individuals showing signs of intoxication. Smoking on board is only allowed in designated areas. Bringing pets on board is allowed only by prior arrangement, strictly under the responsibility of the pet owner, and the animal must comply with the laws governing the presence of pets in public places.

(1.1.2) The captain has the right to modify the schedule according to weather conditions and other unforeseen circumstances that may affect the safety of the journey. The ticket cost will not be refunded for changes related to safety.

(1.1.3) All passengers on board are required to follow safety regulations and crew instructions. Any actions or disregard for rules will be strictly at their own risk and may result in removal from the ship. The ticket cost will not be refunded in case of removal from the trip.

(1.1.4) Each passenger is provided with life-saving equipment, and the ship has two life rafts.

(1.1.5) The service provider has the right to replace the serving vessel on the route as necessary without prior notice. The ticket cost will not be refunded if a replacement vessel is used for the trip.

(1.1.6) Passengers under the age of 18: Children under 18 years of age are not allowed to participate in the cruise without an adult guardian. An individual is considered an adult at the age of 18. For a group of children, there must be at least 1 adult guardian for every 4 children.

(1.1.7) Attention! Participation in the sea cruise is voluntary and strictly at your own risk.

(1.2) TICKET AND SERVICE PRICES

(1.2.1) The service provider has the right to change the price list at any time. If you have made a reservation for a trip but have not yet paid, the service provider guarantees the validity of the price list during the validity period of the price quote or invoice.

(1.2.2) The price quote provided by the service provider to the ticket buyer is based on the prices and availability at the time of the offer. Prices and availability of services change frequently, so the service provider cannot guarantee the availability of tickets at the previously quoted price after the expiration of the offer or invoice validity period.

(1.2.3) To prevent possible price changes, the service provider recommends purchasing selected tickets and services within the validity period of the offer or invoice.

(1.2.4) The service provider’s products are sold through various agents, and it is not always possible to control the nominal values of the price lists used by them. The service provider reserves the right not to accept a price that differs from the price set by the service provider.

2. GENERAL TERMS OF TICKET RESERVATION

(2.1) These Booking and Payment Terms (hereinafter: Terms) apply to reservations and tickets (hereinafter collectively: Tickets) made by Mellson Grupp OÜ (hereinafter: the Service provider) via telephone, online platforms, mobile applications, and travel agencies.

(2.2) Making a reservation and fully or partially paying for the ticket constitutes a binding agreement between the Service provider and the Ticket Buyer (hereinafter referred to as an individual purchasing a ticket or a person responsible for group tickets or chartering the entire ship). The Ticket Buyer also expresses their agreement with these general terms by making full or partial payment for the ticket.

(2.3) These Terms and Conditions apply to all bookings made for the services offered by the Service Provider.

(2.4) Special provisions apply to ticket sales for Charter Trips and/or Special Offers and group trips (hereinafter referred to as “Charter Trips”):

(2.4.1) Tickets for Charter Trips are non-refundable.

(2.4.2) Tickets for Charter Trips can be modified according to separate agreement in each case.

(2.4.3) The terms and cost of a Charter Trip are considered a one-time offer and are not subject to subsequent changes.

(2.4.4) The price of a Charter Trip is fixed by the Service Provider and is not dependent on the price or availability of regular trips.

(2.5) Tickets can be reserved and paid for in the Service Provider’s online or mobile environment, or at a travel agency.

(2.6) Tickets can be modified or cancelled in the Service Provider’s online or mobile environment, or by sending an email to the Service Provider’s representative at cruises@dirhami.ee.

(2.8) Special Requests:

(2.8.1) For passengers with special needs, the Service Provider must be notified at least 48 hours before the scheduled trip.

(2.8.2) Special requests regarding the menu must be communicated to the Service Provider at least 3 working days before the scheduled trip.

(2.9) Tickets will be issued only in electronic form via email to the email address provided by the Buyer.

3. TERMS OF PAYMENT FOR TICKETS

(3.1) In the Service Provider’s online and mobile environment, the Ticket can be paid for immediately upon reservation. For online payments, the customer will receive an automatic ticket and invoice. The customer can request an invoice for payment by bank transfer via email. Please note that an invoice handling fee will be added to the ticket price. The currency for ticket payments is Euro (€). In the online environment, tickets can be paid for via bank links or major credit cards.

(3.2) For bookings made at the Service Provider’s sales office, by phone, or at a travel agency, payment is made based on the invoice provided after the reservation, according to the specified conditions.

(3.3) Different conditions apply to package trips than those specified in these Terms and will be published together with the package trip offer. The package trip agreement becomes effective when the Buyer has paid a deposit or provided a guarantee letter in accordance with the booking and payment conditions for package trips.

(3.4) If the Ticket includes a service provided by a third party partner of the Service Provider, the partner’s booking and payment conditions may apply.

STANDARD CONDITIONS FOR CHANGING OR CANCELLING A TICKET OR BOOKING

The modification of an existing ticket or booking at the customer’s request is subject to the specific fare rules of the ticket or offer, which may differ from the standard conditions listed below.

4. CONDITIONS FOR CHANGING A TICKET OR BOOKING

(4.1) Changing a purchased ticket or booking includes modifications to Passenger Transport services (including changes to travel direction and/or route, departure date or time, total number of group members indicated on the ticket, additional services, on-board services).

(4.2) Changing personal data in the Ticket or booking (name, contact information) is not considered a ticket change.

(4.3) For modifications to Passenger Transport services, the Buyer is liable for a Penalty Fee according to these Terms and Conditions. For services provided by third-party partners of the Service Provider, the Penalty Fee set by the third-party may apply.

(4.4) The ticket or booking can always be modified by paying for the modified services according to the Service Provider’s price list. When changing the price of Passenger Transport services, the price that arises from the price difference between the initially purchased services and the modified services in the booking must be paid, or the price will be refunded, and the applicable Penalty Fee according to paragraphs 4.6 and 4.7 of this section will be applied.

(4.5) No Penalty Fee is applied when changing the ticket or booking more than 30 days before the departure of the trip.

(4.6) The Penalty Fee is applied as follows:

(4.6.1) If the ticket or booking is modified 30 days to 48 hours before the departure of the trip, a Penalty Fee of 10% of the total ticket cost is withheld, and the remaining price difference is refunded as a residual balance.

(4.6.2) If changes are made to the ticket or booking less than 48 hours before the departure of the trip, a Penalty Fee of 20% of the total ticket cost is withheld.

(4.7) If the service provider is forced to cancel the trip due to unfavorable weather or other force majeure reasons, no Penalty Fee will be charged for changing the ticket and additional services.

(4.8) When changing the ticket or booking regarding additional services less than 48 hours before departure, the full cost of the additional services is withheld as a Penalty Fee.

5. CONDITIONS FOR CANCELLATION OF THE TICKET OR BOOKING

(5.1) The Service Provider cancels the ticket or booking if the payment deadline has not been met.

(5.2) When canceling the ticket or booking, a Penalty Fee is required according to these Terms and Conditions. For services provided by third parties, their applicable Penalty Fee will be applied.

(5.3) When canceling the ticket or booking, the amount paid for the ticket will be refunded, minus the Penalty Fee, to the same bank account from which the payment for the ticket was made. The refund will be processed within 60 days. The rates and conditions of the Penalty Fee are listed in sections 5.4, 5.5, 5.6, and 5.7.

(5.4) No Penalty Fee is applied when canceling the ticket or booking more than 30 days before the departure of the trip.

(5.5) The Penalty Fee is applied as follows:

(5.5.1) When canceling the ticket or booking 30 days to 9 days before the departure of the trip, a Penalty Fee of 20% of the total ticket cost is withheld.

(5.5.2) When canceling the ticket or booking 9 days to 48 hours before the departure of the trip, a Penalty Fee of 50% of the total ticket cost is withheld.

(5.5.3) When canceling the ticket or booking less than 48 hours before the departure of the trip, a Penalty Fee of 100% of the total ticket cost is withheld.

(5.6) Non-appearance on the trip is excusable due to force majeure circumstances, and it must be proven by the ticket buyer. The Service Provider evaluates the force majeure circumstances and the evidence provided. If the force majeure circumstance is proven, the amount paid for the ticket will be refunded to the ticket buyer, and no Penalty Fee will be charged.

(5.7) The ticket or booking buyer may leave the amount paid for the ticket as an advance payment for future services provided by the Service Provider.

6. Data Protection, Liability, and Other Conditions

(6.1) DATA PROTECTION

(6.1.1) The personal data collected for processing the Buyer’s order is strictly for internal use within the company.

(6.1.2) If the ticket buyer has given consent, the Service Provider has the right to use the Buyer’s contact information for sending newsletters.

(6.1.3) We confirm that the ticket buyer’s personal data will not be disclosed to third parties unless the data transfer is necessary for the service provider and/or the person involved in providing the service to the ticket buyer. The transfer of data to third parties can only take place with the protection of personal data.

(6.1.4) The ticket buyer’s financial data is not stored on the Service Provider’s servers.

(6.2) LIABILITY

(6.2.1) The liability of the Service Provider is governed by the rules of maritime transport and the 1974 Athens Convention and its protocols. The ticket buyer and their group are insured in accordance with the Athens Convention agreement.

(6.2.2) The Service Provider is not liable for the personal belongings and assets of the ticket buyer and their group unless they have been entrusted to the responsible custody of the Service Provider.

(6.2.3) The ticket buyer (the person responsible for group tickets or the chartering of the entire ship) is fully responsible for the actions of the group they represent and undertakes to fully compensate the Service Provider for any financial damages incurred.

OTHER CONDITIONS

(6.3) The ticket buyer is fully responsible for the actions of the group they represent and undertakes to fully compensate the Service Provider for any financial damages incurred. While on the island, the ticket buyer is responsible for ensuring environmental conservation.

(6.4) Consumption of self-brought food and drinks on board the ship is prohibited.

(6.5) The use of electrical devices on the ship’s power supply is only allowed in agreement with the crew and according to feasibility.

(6.6) On island trips, an additional tariff for transporting personal belongings applies.

(6.7) Pets are allowed on board only by prior agreement and in accordance with the law governing the presence of pets in public places.

(6.8) Each passenger is allowed to bring one travel bag (max 10kg) on board. Additional baggage will be allowed on board subject to availability and for an additional fee.
